1. INTRODUCTION: Welcome to our Au Assist application („App“). This App is published by or on behalf of ZAD BULSTRAD VIENNA INSURANCE GROUP and GLOBAL SERVICES BULGARIA AD, represented by VIG Services Bulgaria Ltd. („VIG-SB“), a company registered in Bulgaria, listed with №121091342 in the Trade Registry, and residing at Inj. "Georgi Belov" №4 Street, 1712 Sofia, Bulgaria.
By downloading or otherwise accessing the App you („User“) agree to be bound by the following terms and conditions („Terms“) and our privacy policy.
2. TERMS OF USE: The App is distributed in the hope that it will be useful, but WITHOUT ANY WARRANTY; without even the implied warranty of MERCHANTABILITY or FITNESS FOR A PARTICULAR PURPOSE. No claims can arise from the use or misuse of this App, or the services it provides. You should have received a copy of the insurance contract, which outlines the terms and conditions of the vehicle assistance or drink&drive services („Services“) offered by VIG-SB. Using the App does not override any such terms and conditions, as it only provides an alternative method to access them.
3. PRIVACY POLICY: As part of the normal functioning of the App, it might require part or all of the following („User Data“):
3.1. STORAGE OF USER DATA: the collected User Data is stored in the local memory of the mobile device, in accordance to the usual security policies of the mobile operating system. As this data is not shared to third parties, it is the sole responsibility of the User to keep it safe from being obtained by an attacker (including, but not limited to, via malware or physical theft of the mobile device).
3.2. TRANSFER OF USER DATA: the collected User Data cannot be automatically transferred to VIG-SB or any third parties, without the knowledge and explicit intent of the User. The act of transferring the relevant part of the User Data can only be triggered by the User when requesting one of the Services. The transfer of User Data, as initiated by the user, happens immediately, over a short-lived encrypted channel. The received Data is stored indefinitely on VIG-SB servers according to the best current security practices. The received user Data is used according to the insurance policy's terms and may require sharing parts of this data, temporarily, to operative units of the organization (including, but not limited to, tow truck operators and request dispatchers). The shared user data is a snapshot of the full User Data contained in the User's mobile phone at the time of the request.
3.3. USE OF ANY RECEIVED USER DATA: while the primary purpose of storing the User Data on the VIG-SB servers is to aid the management of insurance events, VIG-SB acknowledges that this data might be also be used, in rare occasions, for debugging or malicious behavior tracking or any such reasonable operative purposes.
3.4. SHARING OF ANY RECEIVED USER DATA: as part of VIG-SB commitment to the User privacy, any received User Data is not shared with anyone outside the scope of providing the Services. Third parties that receive parts of the data may include tow truck operators, which might not be VIG-SB employees and therefore are not bound with this privacy policy. As VIG-SB has no control over the safe and reasonable use of the data shared with such third parties, VIG-SB only discloses the required minimum data fields, necessary to provide the Services. VIG-SB may also share User Data in compliance with the applicable government laws with regards to criminal investigations and might disclose stored User Data partially or in full upon the receipt of a written court order to do so.
4. SCOPE AND TERMINATION: the outlined terms in 2) and 3) apply to all such Apps for Android, iOS or Windows Phone, and are PERMANENT and NON-TRANSFERABLE, in the sense that any clauses remain enforced even if the User terminates his insurance contract or uninstalls the App. As part of 3.1), the User acknowledges to be aware that uninstalling the App clears any associated User Data stored locally, and this is the recommended procedure when he or she wants to transfer (e.g. sell or give away) the mobile device to somebody else. Any stored User Data on the VIG-SB servers following access to the Services remains in place regardless of the termination of insurance contracts or App uninstalls. Disposal of such stored User Data may happen on an operational basis as part of the standard procedures to free disk space and is not regulated in any way. In particular, VIG-SB is not bound by any data persistence policies and the User can generally assume that stored User Data on VIG-SB servers is kept indefinitely.
